These Terms of Use (“Terms”) govern your use of the Anwesenheit mobile application for iOS and Android (“App”) and the push notification relay service at push.anwesenheit.app (“Push Service”), collectively referred to as the “Service”. The Service is provided by Florian Ludwig Software Engineering (“we”, “us”, “our”).
The App connects to your own Nextcloud server, which may have the Anwesenheit Nextcloud server app installed. These Terms cover the mobile App and Push Service only.
By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service
Anwesenheit is an attendance management system. This Service consists of:
- Mobile App — A companion app for iOS and Android that connects to your Nextcloud server, displays appointments, allows responses, and receives push notifications.
- Push Service — A relay server that delivers encrypted push notifications from your Nextcloud instance to your mobile device via Firebase Cloud Messaging.
The App requires the Anwesenheit Nextcloud server app to be installed on your Nextcloud instance. The server app is free, open source (AGPL-3.0), and not covered by these Terms.
2. Requirements
To use the Service, you need:
- A Nextcloud server (version 32 or later) with the Anwesenheit server app installed
- A user account on that Nextcloud instance
- A compatible mobile device (iOS or Android) for the mobile App
- An internet connection
You are responsible for maintaining access to your Nextcloud server. We do not provide Nextcloud hosting.
3. Account and Authentication
- The App authenticates via Nextcloud Login Flow v2. You log in with your existing Nextcloud credentials.
- An app-specific password is generated by your Nextcloud server during login. We never receive or store your Nextcloud password.
- You are responsible for keeping your device and Nextcloud account credentials secure.
- You may connect multiple Nextcloud accounts within the App.
4. Subscriptions and Payments
4.1 Free Trial
Each Nextcloud server instance receives a free 30-day trial when the App first connects to it. The trial provides full functionality without restrictions.
4.2 Paid Subscriptions
After the trial period, continued use of the App and the Push Service requires a paid subscription. There are two kinds:
Personal license (Personal) — covers you as an individual. The license is tied to your Apple or Google account and applies to every Nextcloud account you sign in with in the App.
Instance license — covers all users of one Nextcloud instance and is offered in tiers based on the number of active App users (users who have actively used the App within the last 365 days):
- Basic — up to 30 members
- Standard — up to 100 members
- Premium — unlimited members
Without an active subscription — neither a personal license nor a license for the instance in question — the App can no longer be used with that Nextcloud instance.
Subscription pricing is displayed in the App and may vary by region and platform.
4.3 In-App Purchases
Subscriptions are purchased through the Apple App Store or Google Play Store. All payments are processed by Apple or Google, respectively. We do not handle payment card information.
4.4 Billing and Renewal
- Subscriptions are billed annually.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage and cancel your subscription through your Apple App Store or Google Play Store account settings.
4.5 Refunds
Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
4.6 Nextcloud Server App
The Nextcloud server app is free and open source (AGPL-3.0). It can be used independently of the mobile App and Push Service without any subscription.
5. Acceptable Use
You agree to:
- Use the Service only for its intended purpose of attendance management
- Comply with all applicable laws and regulations
- Not attempt to interfere with, disrupt, or gain unauthorized access to the Push Service
- Not reverse-engineer, decompile, or attempt to extract the source code of the mobile App (except where permitted by applicable law)
- Not use the Service to transmit malicious, harmful, or illegal content
- Not attempt to circumvent license restrictions or subscription requirements
6. Intellectual Property
6.1 Mobile App
The Anwesenheit mobile App is proprietary software. All rights, title, and interest in the App (including but not limited to code, design, graphics, and trademarks) are owned by Florian Ludwig Software Engineering.
6.2 Your Data
You retain all rights to your data. We do not claim ownership of any content you create, store, or transmit through the Service. See our Privacy Policy for details on how data is handled.
7. Availability and Support
7.1 Service Availability
We strive to maintain the Push Service’s availability but do not guarantee uninterrupted or error-free operation. The Push Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
7.2 Nextcloud Server
The availability of your Nextcloud server and the Nextcloud server app depends on your own infrastructure. We are not responsible for the availability, performance, or maintenance of your Nextcloud server.

8. Limitation of Liability
8.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or business opportunities
- Service interruptions, delays, or failures in push notification delivery
- Actions or omissions of third-party service providers (including Apple, Google, Firebase, RevenueCat, or your Nextcloud hosting provider)
- Unauthorized access to your Nextcloud server or data
- Any damages arising from your use of or inability to use the Service
8.3 Maximum Liability
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us for the Service in the twelve (12) months preceding the claim.
8.4 Exceptions
Nothing in these Terms shall limit our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited under applicable law.
9. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
9.1 Your Nextcloud Data
All appointment data, attendance records, and user content are stored on your own Nextcloud server. We do not have access to, control over, or responsibility for this data. Your Nextcloud administrator is responsible for data protection on your Nextcloud instance.
9.2 Push Notification Data
Push notification content is end-to-end encrypted. Our Push Service relays encrypted payloads without the ability to read their content.
10. Third-Party Services
The Service integrates with the following third-party services:
- Firebase Cloud Messaging (Google) — For push notification delivery
- RevenueCat — For subscription management
- Apple App Store / Google Play Store — For payment processing
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For paid subscribers, we will provide reasonable notice before discontinuing core functionality.
We may update these Terms from time to time. Material changes will be communicated by updating the “Last updated” date and, where appropriate, through the App. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Termination
12.1 By You
You may stop using the Service at any time by:
- Cancelling your subscription through the subscription management of the Apple App Store or Google Play Store
- Disabling push notifications
- Uninstalling the mobile App
- Removing the Nextcloud server app from your Nextcloud instance
12.2 By Us
We may suspend or terminate your access to the App and the Push Service if:
- You violate these Terms
- Your subscription expires and is not renewed
- Your free trial has ended without subscribing
- We are required to do so by law
12.3 Effect of Termination
Upon termination:
- Your device registration on the Push Service will be removed (or automatically after 365 days of inactivity)
- Your data on your Nextcloud server remains unaffected
- Local App data is removed when you uninstall the App
- No refunds are provided for the current billing period upon voluntary termination
13. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.
For consumers within the European Union, mandatory consumer protection laws of your country of residence shall apply insofar as they provide more favorable protection.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Germany.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended purpose.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service. They supersede any prior agreements or understandings relating to the subject matter.
